Terms of Use

Welcome to Blessly. These Terms of Use ("Terms") govern your access to and use of the Blessly mobile application ("App"), website, and related services (collectively, the "Service") operated by Blessly LLC ("Blessly," "we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1) Eligibility

You must be at least 13 years of age to create an account. Certain features, including the Accountability Partner feature, require users to be at least 18 years old. By using the Service, you represent that you meet the applicable age requirements.

2) Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as needed. You may not share your account or credentials with others.

4) Subscriptions and Payments

4.1 In-App Subscriptions

Blessly offers optional auto-renewable subscription plans that unlock premium features of your personal Blessly experience. Subscription details, including pricing, duration, and included features, are displayed on the subscription screen within the App.

These subscriptions apply only to Blessly's own premium features for individual users. Connecting to a church or organization on Blessly — including joining, following, and accessing the membership, content, groups, events, and giving your church or organization provides — is always free to you as an individual user. You are never required to purchase a Blessly subscription to participate with a church or organization.

4.2 Billing

The following billing terms apply only if you choose to purchase an optional Blessly subscription. You are not charged anything for downloading the App, for everyday use, or for connecting with a church or organization — those are always free. No charge is ever made unless you actively buy a subscription and confirm the purchase.

4.3 Free Trial

If a free trial is offered, any unused portion of the free trial will be forfeited when you purchase a subscription.

4.4 Donations and Giving

The App enables users to make donations to churches and faith-based organizations through our integrated giving feature. Donations are processed by Stripe on behalf of the receiving organization. Blessly is a technology platform facilitating these transactions; Blessly does not itself receive or hold donation funds, though it may charge the receiving organization a service or platform fee for use of the platform. Donation receipts and tax documentation are the responsibility of the receiving organization.

4.5 Event Registration and Ticketing

Some events offered through the Service require payment to register or purchase tickets. These payments are processed by Stripe on behalf of the organizing church or organization, not by Apple or Google. The applicable price, fees, and any payment schedule are shown at the time of registration. Where an event offers a payment plan, you authorize the automatic charging of your selected payment method for each scheduled installment until the balance is paid in full or the plan is cancelled as permitted. Refunds, cancellations, and transfers are subject to the policy of the organizing church or organization. Blessly is a technology platform facilitating these transactions and does not set or control event pricing, ticketing, or refund policies.

5) User Content

5.1 Your Content

You retain ownership of content you create, upload, or share through the Service ("User Content"), including community posts, journal entries, prayer requests, profile information, and messages. By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content solely in connection with operating and providing the Service.

We reserve the right, but are not obligated, to review, remove, or disable access to any User Content at our sole discretion, without prior notice, for any reason, including content that we believe violates these Terms.

6) Church and Organization Content

Churches and organizations using Blessly may provide content including sermons, devotionals, announcements, events, and media. This content is created and managed by the respective organization. We do not endorse, verify, or assume responsibility for the accuracy or quality of third-party content provided by churches and organizations.

7) Privacy

Your use of the Service is also governed by our Privacy Policy, available at https://www.blesslyapp.com/privacy-policy, including details on how we collect, use, and store your information and where that information is stored. Where you use the Service on behalf of a church or other organization, that organization is the data controller for its members' personal data and Blessly acts as its data processor, processing that data on the organization's instructions. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

The Service, including its design, logos, text, graphics, software, and all other content created by Blessly, is the property of Blessly and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

10) Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through the App settings.

11) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not provide spiritual, counseling, therapeutic, or professional advice through the Service. The Accountability Partner feature connects users for mutual encouragement but does not constitute professional counseling or therapy.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLESSLY LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU PAID TO BLESSLY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR (B) FIFTY U.S. DOLLARS (US $50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

You agree to indemnify, defend, and hold harmless Blessly from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

14) Third-Party Services

The Service may contain links to or integrations with third-party services, including but not limited to Stripe (payment processing), YouTube (video content), and Apple/Google (subscription billing). We are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is subject to their respective terms and policies.

15) Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date and, where appropriate, providing notice through the App. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

16) Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

17) Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration administered by the American Arbitration Association and seated in the State of Georgia. You agree to waive any right to a jury trial or to participate in a class action.
